The City of Hamilton’s nuisance bylaw is going to be amended to address smell and lighting concerns over large scale personal cannabis growing operations.
Some residents have been taking advantage of a legal loophole by combining their personal licenses for growing medical cannabis with greenhouses and other converted buildings to grow thousands of plants.

Without using proper ventilation within the structure, neighbours and other nearby members of the community can smell the cannabis.
There have been a number of complaints throughout the city of large growth operations and their odour. Complaints of converted greenhouses that aren’t being properly ventilated have been made about properties in Stoney Creek, Glanbrook, Ancaster, and Flamborough.
Under the new by-law, someone can be ordered to fix any odour in a cannabis growing structure. If it isn’t fixed, an individual can be fined up to $5000, or $50,000 for a corporation.
Any concerns that the by-law might affect anyone growing a couple of plants for personal use can be assured that it is designed to specifically target larger scale operations.
